How to get a Green Card: 10 Tips from an Expert

1) You may have $900,000 to get an EB-5 visa, but you don't need to spend all that money to immigrate.

The amount required to apply for an EB-5 Visa is $900,000 - and you still need to generate 10 jobs in the US to do so. But you can get your green card under the EB-2 category if you have a solid resume - and save almost $5 million in the process!

2) What are the main requirements for the EB-2 NIW visa?

Each case is unique, but you meet the requirements to be eligible for an EB-2 visa if you have a bachelor's degree, more than 5 years of work experience, or a master's degree and a stricto sensu doctorate

3)I am eligible for an EB-2 visa. Does this mean I will be approved?

It depends! It's one thing to be eligible, it's another to be admissible. How so? The criteria for eligibility for an EB-2 visa are objective, such as career and employment. But at the same time you need to prove that your work will be relevant to the United States and bring economic, academic, social, or environmental benefits to the country. 4)You don't need to change your profession to immigrate!

If you want to immigrate to the USA, you've probably heard many stories of people who have abandoned everything in Brazil - especially their professions - to start a new life in the United States. This does happen, but if you have a solid career in your field, and can prove your skills to the US government, you can get an EB-2 visa. And in this visa category, you get a green card without the need for a previous offer of employment on U.S. soil.

5) What are the most popular visas? 

Visas: EB-2 NIW, EB-3, E-2. In the EB-2 visa the applicant needs to demonstrate his qualifications and career to the U.S. government, because this type of visa allows the applicant to reside permanently in the U.S. without a previous offer of employment.

On the EB-3 visa, the worker has a sponsor in the United States, which is an employer who will hire that person to perform skilled work in the country. 

The E-2 visa can be obtained via investment, for passport holders from countries that have a trade agreement with the US, such as Italy.

6) What are O and P visas?

The O visa is used in situations where the person will work in the US and return to his/her home country without the intention of living in the US permanently. This visa is often used by artists, singers and athletes, when they perform casual work in the USA. 

The P visa, on the other hand, is used by teams that accompany these casual workers, such as film crews, athletic teams, and others.  

7) No visa gets you a green card, unless you apply for a green card!

It sounds strange, but that's just it! If you have done an L visa or an O visa, for example, there is no guarantee that in a certain time you will have a green card in your hands. To get a green card, either you already have a type of visa that qualifies you automatically(such as EB-2 NIW), or you must be aware of the requirements to apply for a green card as soon as possible to the US government.

8) I already live in the U.S. legally and work in a different field than I did in Brazil. Can I still get a green card?

Yes, a very important question for immigration is: how much tax have you paid in the US? It may sound strange, but this is the way to measure how much wealth you have generated for the US and how much you have returned to the American society.

9) What is the difference between EB-1 and EB-2?

The EB-1 visa is for those who have the highest qualifications and skills in their respective fields. For eligibility, immigration requires the applicant to show that they have received national or international awards in their career. For example, a Brazilian soccer player who won the Libertadores is eligible for an EB-1 green card. Another example of eligibility for an EB-1 visa is if the applicant is a guest member of a professional association. 

In the EB-2 category, the professional must prove a bachelor's degree, have at least 5 years of professional experience, have above average skills in their field, and prove that their work is of national interest to American society.

10) A green card is not an expense, it is an investment!

Having a Green Card can be a great economy: if you are planning your children's college in the USA, the cost of that college can be reduced up to 4x if you and your children have Green Cards. Furthermore, as a professional, you will be able to study and work in the United States and be paid in dollars, also enhancing your expertise in Brazil.
