EB-1 visa requirements

Many professions have a shortage of professionals in the United States, and highly qualified professionals around the world are given preference when trying to obtain their respective green cards. How does this happen? 

In 1990 the U.S. government enacted a new immigration law, which favors skilled workers who have a desire to move to the United States if they can prove eligibility for existing visas. The EB-1 and EB-2 category visas are called National Interest Waiver, where the US government no longer requires a prior job offer for those who prove their high professional skills to US immigration.

Therefore, if a professional proves to US immigration that he is eligible and fulfills all the qualification requirements demanded by US immigration, he will be able to obtain his Green Card using his professional expertise.

The EB-1 visa is called the first preference visa: it is intended for professionals with the highest standing in their respective fields, encompassing those who have international prominence or recognition in their careers.

For example, a soccer player who has won a title of worldwide recognition, such as a World Cup or a Libertadores, would be eligible for an EB-1 visa, as his professional capabilities are awarded at the level of international prominence. So would a soap opera or series actor who won an Emmy award, following the same logic. And this also applies, for example, to a doctor who is an invited member of a renowned international association and who has received international awards at congresses or conferences for his/her work. 

The professional applying for an EB-1 visa must have extraordinary skills in their field or international academic recognition or hold a senior management position in a multinational company. Within these skills, this professional needs to prove that he/she receives a remuneration above the average of his/her peers and that he/she is recognized nationally or internationally for his/her professional expertise. 

The requirements for an EB-1 visa cover the top 5% of professionals in a field, but this is not the only visa that can be applied for by qualified professionals. The second preference visa category (EB-2) covers the majority of qualified professionals, and has fewer requirements for obtaining it. And what are these requirements?

If you have a bachelor's degree, more than five years of work experience , and exceptional or extraordinary professional skills in your field, you may be eligible for a Green Card!

And, if you are approved for a Green Card under this visa category, your spouse and children under the age of 21 will also be granted their respective Green Cards.

All this without you needing a previous job offer in the United States.
