E-2 visa: How it works

If you have a citizenship other than Brazilian, you may be able to obtain a Green Card more easily. This is because there are two categories of visas that give holders the ability to reside permanently in the US, (E-1 and E-2), which are called Trade Treaty and Investor Visas. These visas are similar to the E-5 visa, but require a lower amount of investment in the US than the latter in order to be granted.

According to the U.S. government, these visas are granted to citizens of countries with which the United States maintains treaties of commerce and navigation and are eligible according to the criteria required by U.S. immigration. 

And what are these countries?

Among this list of countries are: Argentina, Austria, Belgium, Denmark, France, Germany, Italy, Japan, Poland and Spain. Brazil is not on this list, so the investor visa for Brazilian investors who do not have another citizenship is category E-5, which requires applicants to invest at least 800 thousand dollars in US territory for eligibility. 

But if you are Brazilian and have Italian citizenship, for example, you may be eligible for an E-1 or E-2 visa if you meet the requirements of US immigration. The E-1 visa is the Trade Treaty visa, and the E-2 visa is the Investor Treaty (E-2) visa.

E-1 and E-2 visas require less investment for eligibility, which makes many Brazilians with European passports try to obtain their Green Cards through them. 

E-1 and E-2 visa eligibility

The E-1 visa is suitable for persons conducting trade between the United States and E-1 classification treaty countries. This trade may include goods, services, banking, insurance, transportation, tourism, technology and technology transfer. The E-2 visa is suitable for those who wish to invest a substantial amount of money in a U.S. business and enter the U.S. to direct or supervise that business.

If you want to immigrate to the United States and have a citizenship that allows eligibility for E-1 or E-2 visas, this may be a good alternative. This is because the investor visa for Brazilians is usually category E-5, which requires a minimum value of 800 thousand dollars of investment in the USA for eligibility. 

But being eligible for an E-1 or E-2 visa does not automatically make them the best alternatives, as you may be eligible under another US visa category that enables you to obtain a Green Card.

The EB-2 visa, for example, covers most professionals who migrate legally to the US, and does not require a prior job offer or investment in the United States.

EB-2 Visa: Which professions give Green Card?

If you prove that you have exceptional skills with a degree of expertise beyond what is found on the market in your field of work, or have advanced degree skills, with higher education and at least 5 years of proven experience, and prove that your field of work is of U.S. national interest, you are eligible to apply for a U.S. EB-2 visa.

Professions such as medicine, aviation, dentistry and information technology are of national interest to the US and you will be able to reside permanently in the country along with your spouse and children under 21 if you are approved.
